Date of Publish: May 28th, 2023TOS - Terms of ServiceBy commissioning us in any kind of way, you are agreeing to the terms of service below. If you have any questions about our TOS feel free to contact us!Any statement can be bound to change if discussed with us, the artists, prior or directly after the commission.I. GENERAL TERMS~ Please write in a clear and organized manner.
~ Provide neat and clear references. Not a wall of text.
~ Any ill behaviour will not be tolerated and your commission will be canceled if such behavior occurs.
~ Follow our rules provided. If you fail to follow the rules, we have the right to decline or cancel your commission and/or the sale of an adopt. If the sale of an adopt is canceled, the rights to the character will be revoked and it can be sold to someone else. This includes custom adopts.II. PAYMENT~ Commissions must be paid in full after the sketch is complete.
~ The currency accepted is USD unless stated otherwise.
[Deviant Art Points: Will only be paid through the commission widget unless stated otherwise].III. PROCESS~ Work In Progress, (WIP[s]), will only be given if the commissioner personally asks for it. WIPs might be given as well if we, the artists, wonder something about the commission.
~ The time for your commission to be completed can be up to 3 months depending on many factors such as:
Health, order of commission, complexity, work, school, family issues or other factors. [If any of the things stated above occur, we will do our best to notify you].IV. CUSTOMER SATISFACTIONWe will try our best to make sure you are happy with the end result.[Adoptables]Sketch Adoptables will be bought in sketch form and then lined and colored once purchased. The customer may request changes to be made to the sketch before the lineart is started. After the lineart has been added, only the colors may be changed. After you confirm that you are happy with the final product, it cannot be changed.We will not make any changes to batch adoptables, but feel free to make small changes yourself after purchasing. These changes are to be made in separate art of the character. The original art is not to be altered in any way that changes the design.We will show wips of custom adopts and you can give input throughout the process. Once you confirm that you are satisfied with the design, it will be finalized.[Commissions]We will happily make minor changes to a finished piece such as removing accidental marks/lines or adding small details that do not majorly change the finished product itself.We will send you a photo after we complete the lineart for you to let us know if you want any changes to be made. Another photo will be provided with these changes to ensure that you are in fact happy. Once you do confirm that you are satisfied, we will not make any adjustments to the drawing.If you are unhappy with the result or no longer want the commission, refunds may be available depending on how much is completed. However if you have already confirmed that you are satisfied and we are past the lineart stage, a full refund will not be available unless it is an adopt that we are able to resell.Once we have sent the final piece or an unwatermarked adopt/character, a refund of any amount is unavailable.V. COPYRIGHT / USAGE POLICYWe, the artists, hold the rights to post the work that we have created and may use it in any way that we like.This does not mean that we will take credit for any characters that we did not create.The commissioner is allowed to use the copyrighted artwork for personal use only unless agreed otherwise.This means that;
~ You may post the image as long as we are credited. You do not have to directly write out credit to us as long as our watermark is clearly visible. You are under no circumstances to claim to have created it.
~ You may not remove or crop out the watermark, however you may zoom in to a certain part of the image for something such as a profile picture as long as credit is given.
~ You may not alter the artwork itself in any way.
~ You may print the art and claim the right of the character(s) but not the drawing itself.
~ You may not use the image to promote yourself/your work without speaking to/giving proper credit to us, the artists.If you break the copyright infringement in any way, all rights previously had to the drawing will be retracted.The following is considered Copyright infringement:~ Reproducing/using the copyrighted artwork commercially. (Meaning making money off of it in any way)
~ Taking Credit for the creation of the artwork.
~ Removing any watermarks/signatures.
~ Altering the artwork without our (the artists’) consent.Talk to us if you have any questions regarding Commercial Rights to the artwork.VI. CANCELING/REFUNDING POLICYWe have the right to decline or cancel your commission and/or the sale of an adopt at any time. If the sale of an adopt is canceled, the rights to the character will be revoked and it can be sold to someone else. This includes custom adopts.If money has not been sent yet, the commissioner has the right to cancel the commission. This will occur before the lineart stage.Refunds may be available depending on how much is completed. However, if you have already confirmed that you are satisfied and we are past the lineart stage, a full refund will not be available unless it is an adopt that we are able to resell.Once we have sent the final piece or an unwatermarked adopt/character, a refund of any amount is unavailableIf you file a chargeback against us, your right to the art/any previous art that we have made for you will be retracted and we have the right to sell the copyrighted characters to new buyers. You will be unable to commission us in the future. We will most likely publicly share your profile along with the situation and warn others about taking commissions from you out of caution.Any statement can be bound to change if discussed with us, the artists, prior or directly after the commission.
